Terms of Service

Notes & Conditions of Agreement:

Balloon Man, LLC does not participate in balloon releases of any kind and balloon releases should not be done on any occasion. While balloons are a natural product and are biodegradable, deflated balloons and ribbon or string eaten by animals can kill them.

All balloons should be disposed of properly after use at all times.

Balloons are, by nature, temporary items. Although Balloon Man, LLC uses only the finest quality balloons, some balloons will occasionally pop or deflate sooner than expected and will also be adversely affected by wind, rain, rough handling, sunlight, and other uncontrollable factors. Latex and micro foil balloons pose no threat to humans, wildlife or the environment when handled responsibly. Broken or un-inflated balloons can cause harm to young children and pets and should be disposed of immediately and properly. Children under the age of seven (7) should be under constant adult supervision while playing with latex balloons. Balloons are a choking hazard, and the client is responsible for not giving balloons to children three (3) years of age and younger.

Weather and Atmospheric Conditions:

Client understands that decor items may be affected by temperature and humidity. And that Balloon Man, LLC cannot be held responsible for the décor in an uncontrolled climate, such as rain or heat, and/or unforeseen acts of nature.

Balloon Man, LLC only uses the best quality balloons, and we will do everything in our power to make sure your balloon décor will hold up for as long as possible. However. Balloon Man, LLC cannot guarantee your balloon décor once delivery and setup has been completed and we have left the premises. *

Should a return visit be requested for repairs, additional fees may apply.

Balloon Man, LLC is not liable for actions by others or weather conditions beyond Balloon Man LLC's control. In that case Balloon Man, LLC retains the right to abort the project at any time should we believe that to continue may damage the reputation of the client and/or Balloon Man, LLC., and/or cause a safety hazard to our client, their guests, and/or employees or contractors of Balloon Man, LLC.

Should inclement weather or other unforeseen circumstances outside of the client’s or Balloon Man LLC’s control keep Balloon Man, LLC from completing the planned delivery or installation, an alternate indoor or covered delivery location will be provided. No refunds will be given.

Latex and/or foil balloons are in no way heat or cold resistant. The gases within balloons expand and contract in hot and cold conditions, respectively. Some popping or shrinking may occur depending on the conditions surrounding your balloon display.

Balloons will be affected by ozone conditions within a room. If, for example, balloons are hanging in an automotive dealership showroom, the carbon monoxide in the room caused by moving vehicles around, could cause balloons to oxidize and deflate more quickly, depending on how often the vehicles are started.

Setup, Delivery, and Installation Process:

The client, or a representative of the client with décor decision making authority, must be present on site while Balloon Man, LLC, it’s contractor(s), or employee(s), is on site.

The client, or a representative of the client with décor decision making authority, must be on time as expressed in the “Event Details/Earliest Arrival for Décor Set Up” section of this agreement. Should the client, or representative of the client with décor decision making authority be late, there will be a $120 per hour charge added to the invoice, prorated by the minute.

As latex is a natural product, balloons will begin oxidizing within hours of delivery. This means that your balloons may begin to give off a velvety sheen and begin to look differently than when first delivered or installed. This is a natural process and cannot be reversed.

If Command® products (hooks or strips) or any other adhesive are used to attach a balloon design to a wall, they have been used by permission from the client. Balloon Man, LLC does not remove Command® products or other adhesive from walls. It is up to the client to remove and dispose of this décor. Balloon Man, LLC will not be held responsible for any damage done to the wall or other surface when adhesives are used.

There must be convenient access to the venue. Excessive distance from the location where the balloon décor will be placed may result in additional fees.

Payment and Cancellation Information:

Deposits of 50% of the total invoice are due within ten (10) business days of booking your event. Your event date is not secured until the deposit or full payment is received. All deposits are non-refundable unless otherwise indicated. The balance of your payment, unless paid in full, is payable to Balloon Man, LLC within 3(three) days of your delivery.

Balloon Man, LLC accepts cash, checks, and all credit or debit cards. There will be a $25 additional fee upon returned checks plus any additional bank or processing fees. A 3.2% fee will be added to the invoice for any credit or debit card purchases.

Cancellation of the decor by the client for any reason shall forfeit the deposit.

Any changes made to the order after the deposit has been made may result in additional fees.

There will be a last minute fee of 20% added to any invoice when an order has been placed within seven (7) days of the delivery date for your event.

Balloon Man, LLC reserves the right to withdraw from an event due to unforeseen circumstances, such as accident or emergency, illness, or extreme weather conditions. In the rare event that Balloon Man, LLC must cancel this agreement, any monies paid to Balloon Man, LLC shall be refunded to the client within seven (7) to ten (10) business days of the cancellation.

If Balloon Man, LLC or the client must cancel the engagement due to an act of God, riot, strike, epidemic, or by the order of any public authority, this contract shall become null and void. All deposit and balance payments shall be refunded, and both parties shall have no further legal recourse against each other.

For subscription clients: If you need to cancel our cyclical service, you must notify Balloon Man, LLC in writing at least thirty (30) days in advance. If you have not notified Balloon Man, LLC in writing at least thirty (30) days in advance, you will be responsible for a final invoice if we are not able to process your cancellation request before the final installation is completed.

*Subscription clients will have periodic check-ins as needed and agreed upon.

Agreement Severability

If any provision of this Agreement is held illegal or unenforceable in a judicial proceeding, such provision shall be severed and shall be inoperative, and the remainder of this Agreement shall remain in effect by both Parties.

Payment of the deposit by you, the client, indicates that you have read, understand, and accept the above conditions of this agreement. Payment of the deposit also indicates that you accept the event information to be correct and accurate.
